If a novel or complex legal question comes up during proceedings before an arbitrator, the question can be referred by any of the parties involved in a dispute via the arbitrator, or by the arbitrator dealing with the dispute, to the President of the Commission.

The President's opinion on the Question of Law must be taken into account when the arbitrator makes his or her decision on the outcome of the case.

In most cases, the proceedings before the arbitrator will continue while awaiting the President's decision.
