What is an 'Election to Discontinue Proceedings'?

If the applicant to proceedings before the Commission elects not to proceed with a matter or a part of a matter, an Election to Discontinue Proceedings form is to be given by the applicant to the Registrar, and served on all affected parties as soon as practicable.

Where the applicant discontinues

An applicant can decide to discontinue proceedings or any part of the proceedings by lodging an Election to Discontinue Proceedings - Form 14B. Download Form 14B or call us for a copy on 1300 368 040.

The applicant must send this documentation to all the other parties involved in the dispute.

When the above form is filed with us, the matter is considered closed. This means no further action can be taken in relation to the proceedings or those parts of the proceedings that have been discontinued.
